CONTECH’s qualifications can be best demonstrated by recent and past
examples of its work - assignments undertaken and managed by its Principals and
Associates. The following descriptions are representative of CONTECH’s
experience and qualifications.

Schedule Delay Analysis and Damages Analysis
|
|
CONTECH performed a schedule analysis including the preparation of an
As-planned vs. As-built CPM schedule, tracking incremental delay, the
dependencies, relationships, and responsibilities for the delays. CONTECH
established the validity of the As-planned schedule and tied it effectively to
the underlying job records. CONTECH also performed damages analysis. The delay
claim involved a $30 Million action for the demolition and restoration of a
major downtown office building.
On behalf of the City of New York, CONTECH undertook and successfully
performed an evaluation of the delay claims and provided litigation assistance
for the Brooklyn Municipal Building.

Damages Analysis |
|
CONTECH was responsible for evaluating the damages sought in a civil action
which exceeded $400 Million related to a fire and resulting destruction of ten
floors of a thirty-eight-floor high rise office/hotel building. CONTECH prepared
expert opinions, disclosure statements, assisted in the discovery process and
settlement of the action for less than one-quarter of the sought after damages.

Contract Administration, Evaluating Claims, Litigation Support and Expert
Testimony

CONTECH’s Principals and Associates have performed assignments which
include forensic investigations including building code analysis, project
evaluations and workouts, surety loss evaluations including default
terminations, re-letting or turnarounds of work programs, product liability
including testing for defects in materials, fabrications or workmanship, fire
cause and origin investigations, property and casualty losses, and workers’
compensation cases including related actions involving wrongful death.

Professional Liability Claims
|
|
CONTECH’s Principals and Associates have conducted more than fifty separate
assignments for various professional liability insurance companies involving
claims analysis and litigation support. For example, CONTECH evaluated facts
associated with settlement discussions regarding a significant claim against a
major international design firm to assist its client to resolve issues that were
impeding settlement.

Surety Bond Claims
|
|
CONTECH has been involved in numerous claims related to airports, highways,
institutional facilities and power plants. For example, CONTECH has been
involved in the following surety matters:
CONTECH performed an initial investigation of an alleged default and cure
notice issued by a general contractor to a subcontractor on multiple projects.
This assignment included site investigations, estimating the cost to complete
the work, identifying several mitigating factors and defenses, and preparation
of an action plan.
CONTECH performed financial evaluation of multiple projects as a result of a
cash flow assistance request from a general contractor. CONTECH set up accounts
payable systems, tracked payments to all vendors and subcontractors, and
approved payment application requests.
CONTECH performed bid relet service by preparing bid packages, managing
safety and maintenance services during the period between the default of the
principal and resumption of construction and provided completion schedules for
the project.
CONTECH provided technical expertise to a major surety involving a troubled
mechanical contractor working on a major sports facility in the Southeastern
United States.
CONTECH has done follow-up work of a prior consultant in order to conclude a
matter for a surety.

Wrongful Death Claim
|
|
CONTECH investigated a wrongful death action by a construction worker’s
estate against the owner of a major office building. The death occurred during
the performance of demolition and asbestos abatement work. The Principals
investigation resulted in demonstrating the owner’s compliance with all
occupational, safety and health regulations at the local and national levels;
the investigation and reconstruction of the accident clearly demonstrated worker
error.

Project Neutral
|
|
Several of the Principals and Associates are standing members of the American
Arbitration Association and have served as arbitrators on numerous occasions. As
an example, CONTECH successfully mediated a $25 Million dispute between the
prime contractor and a turnkey contractor supplier related to the design and
supply of the equipment and systems for a major geothermal power plant project.

Remedial Design and Analysis
|
|
CONTECH undertook an assignment to perform remedial design, procurement and
construction management for modifications and restoration of a high rise
building. The work involved mechanical systems including HVAC, emergency systems
including emergency generators and architectural/structural modifications.

Project Development
|
|
CONTECH undertook an assignment to assist a major West German corporation in
the evaluation and structuring of a build-own-operate project financing for a
desalination, wastewater treatment process water recycling project, and inside
the fence power generation facility producing electricity and process steam,
located in Mexico. The assignment included development of the technical and
commercial scope, preparing a risk management plan which included a wrap-up
insurance program, preparing capital cost estimates based upon conceptual
designs, preparing a project schedule which included contingencies for
mitigating risk of schedule guarantees, estimating operating cost and preparing
twenty year projections of operating results, performing operational reviews for
reliability and availability, soliciting bids, negotiating awards, allocating
risks between participants and preparing turnkey contracts for equipment supply,
installation and services.

Economic, Financial and Technical Feasibility Studies
|
|
CONTECH completed a financial and technical feasibility study for a de-inked
market pulp mill to be project-financed, non resource basis, with tax exempt
industrial development bonds ($160 Million). This study included, among other
things, technical and physical plant descriptions, process and equipment
descriptions, wastepaper supply survey and strategy, market survey and strategy
for product sale, capital cost estimates, implementation schedule, twenty-year
projection of operating results, sensitivity analysis with internal rate of
return, debt service coverage ratios and break even points, and a project
financing plan. The study incorporated the results of fixed price, guaranteed
bids for the works. The project included a 400 BDSTD DMP mill, restoration and
modification of an existing power generating station for the supply of process
steam and electricity, a volume reduction plant for waste products, an
aerobic-anaerobic wastewater treatment plant including process water recycling,
a water treatment plant for makeup, a materials recycling facility to
sort-screen-select recyclables and to provide the feedstock for the mill.
CONTECH’s Associates completed a study for the development of an anthracite
waste fueled power production and methanol production facility. This study
included collection of conceptual design data, preparation of engineering and
construction cost and a preliminary financial analysis.
CONTECH’s Associates directed the development of a cogeneration facility in
New York. This work included management of design engineering, performing the
project financial analysis and preparing FERC license application.

Project and Construction Management
|
|
CONTECH’s Associates managed the re engineering and construction of
improvements to, and operation of, an 80MW cogeneration power plant. This
assignment included managing the redesign of water treatment, ash handling and
fuel handling systems; it also included the direction of all plant personnel for
operations and maintenance work.
CONTECH’s Associates managed the construction of a $50 Million expansion
project to a large petrochemical facility. The assignment included supervision
of the procurement, staffing and construction of the project and resolution of
design and material problems to ensure the completion of the project within the
planned schedule and budget.
